WaveKey Terms & Conditions

These Terms & Conditions (“Terms”) govern your purchase and use of WaveKey products and services, including our NFC keychains (“WaveKey” or “keys”) and associated subscription plans (collectively, the “Service”).
By purchasing a WaveKey, subscribing to any WaveKey plan, or using wavekey.fit (the “Site”), you agree to be bound by these Terms.
If you do not agree to these Terms, do not purchase or use WaveKey.
1. What WaveKey Is
WaveKey is an NFC keychain capable of storing a single bit of information such as:
A URL or website,
A username or handle for a social platform,
An email address, or
A phone number / text contact.
When tapped on a compatible device, the WaveKey triggers the stored information.
WaveKey does not host or control any third-party websites or platforms you link to, and we are not responsible for the content, policies, actions, or availability of those third parties.
2. Subscription Plans & Term Length
We currently offer the following subscription plans (the “Plans”):
Basic Plan
Billed on a recurring basis (e.g., monthly or annually, as shown at checkout).
Includes limited replacement / reflash rights as described in Section 3.
Yearly Plan
Billed on a yearly recurring basis.
Includes expanded replacement / reflash rights as described in Section 3.
Lifetime Plan (10-Year Term)
One-time purchase price covering a 10-year service period from the date of activation.
Includes the replacement / reflash rights described in Section 3 for each 360-day period during that 10-year term.
“Lifetime” refers to a 10-year service duration, not the literal lifetime of any person or product.
The specific price, billing frequency, and included features for each Plan are displayed at checkout and may change from time to time, as permitted by these Terms.
3. Replacement & Reflash Policy
A “replacement” means sending you a new physical WaveKey.
A “reflash” means changing the information programmed into an existing key.
To request a replacement or reflash, you must:
Use the replacement/reflash link available on the main page of wavekey.fit, and
Provide the email address used for your subscription purchase so we can verify your Plan and eligibility.
3.1 Basic Plan
You are entitled to 1 replacement OR 1 reflash per 180 calendar days.
This means you may request one service action (either a replacement or a reflash) in any 180-day period.
3.2 Yearly Plan
You are entitled to up to 3 replacements or reflashes per 360 calendar days.
You may use these in any combination (e.g., 2 replacements + 1 reflash, or 3 reflashes, etc.), up to a total of three service actions in any 360-day period.
3.3 Lifetime Plan (10-Year Term)
You are entitled to a maximum of 4 replacements and up to 3 reflashes per 360 calendar days during your 10-year service term.
We may cap total service actions or clarify usage thresholds to prevent abuse, as reasonably determined by us.
3.4 Abuse & Fraud
These Plans are designed for normal use. We reserve the right, in our sole discretion, to deny, delay, or limit replacements or reflashes if we reasonably believe there is:
Abuse (e.g., repeatedly and intentionally damaging keys just to get new designs),
Fraud, or
Misuse of the Service.
3.5 Shipping & Turnaround
Replacements will generally be processed and shipped within a commercially reasonable time after approval. We do not guarantee specific shipping or turnaround times, and delays may occur due to stock, logistics, or other factors.
4. Subscription Billing, Auto-Renewal & Cancellation
4.1 Billing & Auto-Renewal
For Basic and Yearly Plans:
Your Plan will automatically renew at the end of each billing cycle until you cancel.
By starting a subscription, you authorize us (or our payment processor) to charge the applicable subscription fee to your selected payment method at each renewal.
For the Lifetime (10-Year) Plan:
You pay a one-time fee.
There is no auto-renewal, but your service eligibility automatically ends after the 10-year term.
4.2 How to Cancel
You may cancel your subscription at any time via the method described on the Site (for example, through your account page or by contacting us at info@wavekey.fit, as applicable).
Cancellation takes effect at the end of your current billing period.
You will retain access to your Plan benefits until that date.
We do not guarantee prorated refunds for unused time, except as we may choose to grant on a case-by-case basis.
4.3 Refunds
All sales are generally final. However, we may, at our sole discretion, provide a refund, credit, or other adjustment on a case-by-case basis (for example, in case of clear defects or ordering errors).
Our decision regarding any such accommodation is final and does not create an obligation to grant refunds or credits in the future.
5. Ownership & Non-Transferability
Each subscription is tied to the individual purchaser (or the entity that purchased it) and is not transferable to another person or entity without our express written permission.
We may allow you to program WaveKeys for your own use, your business, or for gifting, but the underlying subscription rights (replacement/reflash limits, support, etc.) remain tied to your account and purchase.
6. User Content & Prohibited Uses
You are solely responsible for the information you choose to store in a WaveKey and for any link or contact information it points to.
6.1 Allowed Information
WaveKey may store, for example:
URLs and websites,
Usernames/handles for social platforms,
Email addresses,
Phone numbers or text contact details,
Links to lawful adult or sex-work content (e.g., OnlyFans), provided it complies with all applicable laws and platform policies.
6.2 Prohibited Content
WaveKey will not program keys with content that we deem, at our sole discretion, to be prohibited or inappropriate. Prohibited content includes, without limitation:
Illegal content or content that promotes or facilitates illegal activity.
Harassment, threats, or incitement of violence toward any individual or group.
Hate speech or material that targets individuals or groups based on protected characteristics.
Any content involving minors, including child sexual abuse material (CSAM), or links that could reasonably lead to such material.
Malware, viruses, or malicious software, or links designed to compromise devices, accounts, or data (phishing, credential harvesting, etc.).
Fraudulent schemes, scams, or deceptive practices (including misleading financial or investment schemes).
Non-consensual sharing of private information (doxxing) or invasion of privacy.
Any content that, in our sole judgment, may expose us to legal liability or reputational harm.
Important:
We do not treat lawful, consensual adult/sex-work content (such as OnlyFans) as prohibited solely because it is adult content. However, such content must still fully comply with applicable laws and the policies of any platforms involved.
6.3 Our Discretion
WaveKey reserves the right, at any time and without obligation to you, to:
Refuse to program or reflash a key,
Disable or decline to service keys associated with prohibited content, or
Take other steps we deem reasonably necessary to comply with law or protect our business.
7. Third-Party Content & Links
WaveKey acts as a trigger or pointer to content and platforms you choose; we do not control or endorse any third-party content.
We are not responsible for any third-party websites, apps, services, platforms, or content you link to using a WaveKey.
We do not guarantee the accuracy, availability, legality, or safety of any third-party content.
Any interaction with third parties is solely between you and those third parties.
You are solely responsible for ensuring that any content you link to is lawful, appropriate, and compliant with the policies of those platforms.
8. Eligibility
By purchasing or using WaveKey, you represent and warrant that:
You are at least 18 years old, or you have the consent and supervision of a parent/legal guardian;
You reside in the United States; and
You are not barred from using the Service under applicable law.
9. Privacy & Data
WaveKey collects only the basic information reasonably necessary to provide and support the Service, such as:
Your name,
Email address,
Shipping address,
Payment information (processed via a secure third-party payment processor), and
The specific link or contact information you choose to have encoded into your WaveKey.
We do not intentionally collect more personal information than required to fulfill your order and program your key. However, third-party providers (such as payment processors or hosting providers) may collect additional technical or usage data (e.g., IP addresses, device identifiers, analytics) under their own privacy policies.
By using WaveKey, you consent to our handling of your information as described in these Terms and any separate Privacy Policy we may publish.
10. Intellectual Property
All rights, title, and interest in and to:
The WaveKey brand, logos, and trademarks,
The Site (wavekey.fit) and its content,
The design and software related to WaveKey,
are owned by WaveKey (or its licensors).
You receive a limited, non-exclusive, non-transferable license to use WaveKey solely as permitted under these Terms.
11. Disclaimers
To the fullest extent permitted by law:
No Warranty.
WaveKey and the Service are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or arising from course of dealing or usage of trade.No Guarantee of Uninterrupted Service.
We do not warrant that the Site, programming services, or NFC functionality will be uninterrupted, secure, or error-free, or that any defects will be corrected.No Responsibility for User Choices.
We are not responsible for:The information you choose to encode in a WaveKey;
Any loss of data or changes you make;
The behavior, content, or security of third-party websites or platforms;
Any consequences of your use of a WaveKey in connection with third-party services.
12. Limitation of Liability
To the fullest extent permitted by law:
WaveKey and its owners, officers, employees, agents, and affiliates (collectively, the “WaveKey Parties”) shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including without limitation loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service, even if advised of the possibility of such damages.
In no event shall the total aggregate liability of the WaveKey Parties for all claims arising out of or relating to the Service or these Terms exceed the greater of:
(a) the amount you paid to WaveKey for the product or subscription giving rise to the claim during the 12 months preceding the event, or
(b) $100 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, the liability of the WaveKey Parties shall be limited to the fullest extent permitted by applicable law.
13. Indemnification
You agree to indemnify, defend, and hold harmless the WaveKey Parties from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
Your use or misuse of WaveKey or the Service,
The content you encode into WaveKeys,
Your violation of these Terms, or
Your violation of any rights of another person or entity.
14. Governing Law & Dispute Resolution
These Terms and your use of the Service are governed by:
The laws of the United States, and
To the extent required or applicable, the laws of the state in which you reside,
in each case without regard to conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be brought in competent courts within your state of residence, unless applicable law requires a different forum. You agree to submit to the personal jurisdiction of such courts and waive any objection based on inconvenient forum.
Nothing in this section limits any rights you may have as a consumer under the mandatory laws of your state.
15. Changes to the Service & These Terms
We may:
Modify, suspend, or discontinue any part of the Service, and/or
Update or revise these Terms
at any time, in our sole discretion.
When we make material changes to these Terms, we will provide reasonable notice, which may include:
Posting the updated Terms on the Site with a new “Last updated” date, and/or
Sending a notice to the email associated with your account (if applicable).
Your continued use of WaveKey or the Service after the effective date of updated Terms constitutes your acceptance of those changes.
16. Termination
We may, in our sole discretion, suspend or terminate your access to the Service or any subscription, without refund, if we reasonably believe you have:
Violated these Terms,
Engaged in fraud, abuse, or illegal activity, or
Used the Service in a manner that could harm us or others.
You may stop using WaveKey at any time and, where applicable, cancel your subscription as described in Section 4.

18. Entire Agreement
These Terms constitute the entire agreement between you and WaveKey regarding the Service and supersede any prior agreements or understandings (written or oral) relating to the same subject matter.
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
